Terms of Use

These terms of use (“Terms of Use“) tell you about the terms and conditions applicable to the use of our ISIC application and mobile website m.isic.org (together: the “application“).

Please read these Terms of Use carefully before you start to use the application. By using the application, you indicate that you accept these Terms of Use and that you agree to abide by them.

1. INFORMATION ABOUT US

1.1 This application is operated by ISIC ASSOCIATION (INTERNATIONAL STUDENT IDENTITY CARD ASSOCIATION) (“we“, “our“, “us“). We are registered in Denmark. Our registered office is at Nytorv 5, 1450 København K, Denmark. Our Company ID No. (CVR) is 26746760.

2. YOUR PERSONAL INFORMATION

2.1 When using the application, you may provide certain personal information. We process information about you in accordance with our Privacy Policy.

3. YOUR ACCOUNT AND PASSWORD

3.1 If you set up an account on the application, you must treat your login details as confidential. You must not disclose them to any third party.

3.2 We have the right to disable any account at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

3.3 If you know or suspect that anyone other than you knows your login details, you must promptly notify us at mobile@isic.org.

3.4 Insofar this is enabled in your country and the application provides such option, the Virtual ID (or as it may be referred to in the application) can be used as a valid ISIC Card. Please note that the Virtual ID may require additional account information and a suitable picture in order to be valid.

3.5 Whenever your identity card is withdrawn by the issuer, your account will be deleted automatically from the ISIC App.

4. RULES OF ACCEPTABLE USE

4.1 In addition to the other requirements within these Terms of Use, this section describes specific rules that apply to your use of the application and any other interactive feature of the application (the “Rules of Acceptable Use”).

4.2 Our application may be used to find discounts, promotions and deals specifically for valid ISIC cardholders as they are made available by partners using the platform.

4.3 If you are under 16 years of age, your parents or legal guardians must consent to your sign up in the application. If you are under 16 years of age, you will be prompted to provide a parent or legal guardian’s name and e-mail address. A verification code will be sent to the provided e-mail address along with these Terms of Use and our Privacy Policy. The verification code must be entered into the application at sign up. Entering the verification code constitutes consent from the parent or legal guardian.

4.4 When using the application you must not:

(a) circumvent, disable or otherwise interfere with any security related features of the application or features that prevent or restrict use or copying of the content accessible via the application;

(b) give any false information in your account details;

(c) take another person’s identity without that person’s permission or misrepresent that you are acting on behalf of a person, entity or organisation;

(d) use the application if we have suspended or banned you from using it;

(e) send junk, spam or repetitive messages;

(f) engage in any illegal or unlawful conduct;

(g) modify, interfere, intercept, disrupt or hack the application;

(h) misuse the application by knowingly introducing viruses, Trojans, worms, logic bombs or other similar material or by undertaking any other action which would harm the application, any application user’s equipment or have a detrimental impact on any application user’s experience of using the application;

(i) collect any data from the application other than in accordance with these Terms of Use.

4.5 Failure to comply with the Rules of Acceptable Use constitutes a serious breach of these Terms of Use and may result in our taking all or any of the following actions (with or without notice):

(a) immediate, temporary or permanent withdrawal of your right to use the application;

(b) issuing of a warning to you;

(c) legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; and/or

(d) disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

4.6 The responses described above are not limited and we may take any other action we reasonably deem appropriate.

5. NOTICE AND TAKE DOWN POLICY

If you believe that content available through the application infringes your rights or any rights of a third party you represent or otherwise breaches the Rules of Acceptable Use, please tell us immediately by sending us an email to info@isic.org.

5.1 When reporting content please provide the information described below in your notice to us:

(a) your name and contact details; and

(b) a statement explaining whether you believe that the content you are contacting us about:

(i) infringes your rights;

(ii) the rights of a third party who you represent; or

(iii) you otherwise believe the content breaches the Rules of Acceptable Use.

5.2 We will take the action that we believe is appropriate depending on the nature of the content you report. This may include taking no action where we believe the reported content does not infringe any rights, fair use or the Rules of Acceptable Use. We are not obliged to discuss or inform you about our chosen course of action following a report from you.

6. LIMITED LICENCE

6.1 We are the owner or the licensee of all intellectual property rights in the application and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. We grant you permission to access the application for your personal use only. Any other use of the application or the application’s content is prohibited. This prohibition includes, but is not limited to:

(a) making commercial use of the application’s content;

(b) reproduction of the ISIC name, logo, trademarks or any other content available on the application; and

(c) downloading or copying any of the application content for yourself or for a third-party.

6.2 If you wish to make any use of material on the application other than that set out above, please contact: info@isic.org.

7. DISCLAIMER AND LIABILITY

7.1 Please appreciate that the application is a free service of ISIC, and that access to the application is permitted on a temporary basis and that we may limit or terminate access to the application at any time without any notice. We will not be liable if the application is unavailable at any time or for any period.

7.2 We have taken care in the preparation of the application and the content thereof. However, we will not be responsible for any errors or omissions or for any technical problems you may experience with the application. If we are informed of any inaccuracies in the content on the application we will attempt to correct this as soon as we reasonably can. We exclude all warranties and conditions (implied or otherwise) to the extent permitted by applicable law.

7.3 Whilst we make reasonable efforts to ensure that any information presented on the application is correct, the information on the application is presented without any guarantees, conditions or warranties or any kind and the application is made available to you on an “AS IS” basis. We are not responsible for anything that occurs from your reliance on the content of the application.

7.4 Because the application is provided free of charge, we will not, in any way, be liable for any loss or damage (whether direct or indirect), breach of contract, breach of statutory or otherwise (even if foreseeable) in connection with any use you make of the application or the information presented on it.

7.5 If you are browsing the application as a consumer, then nothing in these Terms of Use or any additional terms limits any consumer’s legal rights which cannot be changed by these Terms of Use.

8. LINKS AND LINKING

8.1 Links to third party websites from the application are provided solely for your convenience. If you use these links you leave the application. We do not control, and are not responsible for, these websites, their content or their availability. We, in no way endorse, or make representations about them, or any material found on them. Accessing third party websites from the application is done entirely at your own risk.

8.2 You may link to our home page www.isic.org, provided you do so in a way that is fair, legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You agree to remove any link to the application on a website owned or controlled by you on receipt of a request from us.

9. MAPS

9.1 The map data on ISIC.org and ISIC mobile app is provided by 3rd parties and it doesn’t imply the expression of any opinion whatsoever on the part of the ISIC Association concerning the legal status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries.

10. VARIATIONS

10.1 We may revise these Terms of Use at any time by amending this page. You should check this page from time to time to take notice of any changes we make.

11. SEVERABILITY

11.1 If any of these Terms of Use is held to be invalid, the remaining terms and conditions shall continue to be valid to the fullest extent permitted by law.

12. JURISDICTION AND APPLICABLE LAW

12.1 Depending on where you are domiciled, the courts of Copenhagen, Denmark will have jurisdiction over any claim arising from, or related to, a use to the application although we retain the right to bring proceedings against you for breach of these Terms of Use in your country of residence or any other relevant country. Depending on where you have your habitual residence, these Terms of Use are governed by Danish law.

12.2 Insofar as permitted by local law, these Terms of Use are governed by Danish law. This does affect any right you may have under mandatory local law, including any right you may have to bring a claim to your court of residence.
